The Obama administration is in clear violation of the Logan act by currently being in contact with the Iranian government. According to the Daily Beast the Obama administration officials are in contact with the Iranian government as tensions rise with the U.S. and Iran. Apparently they are going behind Trumps back giving Iran advice on how to deal with Trump.
The Daily Beast wrote, “As the Trump administration sent warplanes and an aircraft carrier to the Persian Gulf, a small group of former Obama administration officials reached out to their contacts in the Iranian government, including Foreign Minister Mohammad Javad Zarif.”
The Daily Beast continued, “Their message to Iran: Don’t take Trump’s bait. Stay calm.”
The Daily Beast noted how long and how these people communicate, “Conversations between former Obama officials and Iranian government officials have been ongoing since November 2016. Zarif, who visits the U.S. every year for the U.N. General Assembly in New York, usually meets with lawmakers, think tanks, journalists, and former officials when he is in town.”
However, the most recent increase in conversations have been “over the phone and in person over the last two months,” due to the fact their lines of intermediaries in Europe have deteriorated.
The Obama administration answered the Daily Beast claiming these actions they are taking are normal, but Republicans feel differently. One Republican aide believes the Obama administration is attempting to isolate the Trump administration from Iran.
The Republican aide stated to the Daily Beast, “It’s not just about what they were saying to the Iranians. It’s about what they were saying to their political allies back here in the U.S. Their strategy was to divide and isolate the Trump administration just as the Trump administration was trying to re-establish deterrence with Iran. In the current highly partisan political environment, the only safe course is to signal national unity—and they contributed to eroding that at home and abroad.”
The Obama administration is in clear violation of the Logan act because they are no longer in political office to have power of negotiations on behalf of the United states.
The Logan act reads,
Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.
This section shall not abridge the right of a citizen to apply, himself or his agent, to any foreign government or the agents thereof for redress of any injury which he may have sustained from such government or any of its agents or subjects.
